The Montevideo Memorandum came into being after the preparation of the Investigation Report of the Commissioner for the Protection of Personal Data of Canada on Facebook (July 2009), although it is based on an independent social and legal analysis, decidedly Ibero-American, guided by the Multinational and multidisciplinary group of experts from Montevideo.
This empirical and legal background guided the preparation of this reference document, thereby ensuring its relevance to the challenges of the digital age and taking into account the social and legal reality of the Ibero-American region. The experience of our Commissioner in the investigation related to Facebook contributed to the preparation of the Montevideo Memorandum to reflect in said document the challenges and legal and economic solutions resulting from the survey, which led to the modification of Facebook's confidentiality parameters around the world.
The importance of the Montevideo Memorandum can be summarized in four points that I will address individually, namely; its solid empirical base, its clear, pertinent and exhaustive regulatory framework, its structure specifically directed at the different actors at stake, and its legal rigor.
